Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using AnyVocab (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver in Section 9, you may not access or use the Service.

2. Description of Service

AnyVocab is an AI-powered language learning platform that provides a custom user interface built on top of third-party AI models (such as Google Gemini and DeepSeek) to facilitate vocabulary acquisition. We are an independent service provider and strictly define our platform as a specialized interface for these underlying technologies. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts & Eligibility

• Age Requirement: You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You notify us immediately of any unauthorized use of your account.
• Registration Data: You agree to provide accurate, current, and complete information during the registration process.

4. Subscriptions, Payments & Refunds

• Billing: Subscription fees for "Pro" plans are billed in advance on a recurring basis. We use Creem as our payment processor.
• Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will prevent future charges but does not entitle you to a refund for the current billing period.
• No Refunds: All payments are non-refundable and non-transferable. We do not provide refunds or credits for any partial-month subscription periods or unused service.
• Price Changes: We reserve the right to adjust pricing for our Service at any time. Any price changes will take effect following notice to you.

5. Intellectual Property & Content Rights

A. Your Content

You retain all rights to the text, audio, and materials you upload or generate ("User Content"). By using the Service, you grant AnyVocab a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process your User Content solely for the purpose of providing and improving the Service.

B. AnyVocab Content

All rights, title, and interest in and to the Service (excluding User Content and third-party content) are and will remain the exclusive property of AnyVocab and its licensors.

6. Third-Party Integrations

Our Service interacts with third-party platforms. By using these features, you agree to their respective terms:

• YouTube: By importing videos, you acknowledge bound compliance with YouTube's Terms of Service and Google's Privacy Policy.
• AI Outputs: The Service utilizes extensive AI models (e.g., Gemini, DeepSeek). You acknowledge that AI output can be unpredictable, may hallucinate, and may contain inaccuracies. You should not rely on the Service for professional legal, medical, or financial advice.

7. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the software.
• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Interfere with or disrupt the integrity or performance of the Service (`DDoS`, scraping, etc.).
• Share your Pro account access with multiple individuals.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL ANYVOCAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless AnyVocab from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal fees and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located within mainland China.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
